Agreement and operator

These terms form a binding agreement between you and Shiptavio for the Shiptavio website, customer dashboard, and related services.

If you use Shiptavio on behalf of a company or another organization, you confirm that you have authority to bind it. In that case, "you" includes that organization.

If you do not agree to these terms, do not use Shiptavio.

Eligibility and accounts

You must be at least 18 years old and legally able to enter into a contract. You must provide accurate account information, keep it current, and complete email verification when asked.

Keep your login credentials secure. You are responsible for all activity under your account. Tell us promptly if you believe someone has accessed your account without permission.

The service and publisher of record

Shiptavio helps you build, sign, upload, submit, and manage mobile apps through Apple's App Store and Google Play.

Apps published through Shiptavio are published under our own developer accounts. The store listing shows the developer or seller name of the account used to publish the app until it is transferred to your own developer account. We confirm the seller of record with you after payment, before your release starts.

We provide the publishing service. We do not own your app, operate your app, or control your app's users.

Your app and your responsibilities

You are responsible for your app and everything you submit with it. You agree to:

  • Submit only apps that you own or have all necessary rights and licences to publish.
  • Keep your app, store metadata, screenshots, privacy answers, and age ratings accurate, complete, and not misleading.
  • Comply with Apple and Google policies, applicable law, and the Prohibited Apps policy.
  • Publish and maintain a privacy policy for your app, and provide accurate data safety and privacy disclosures.
  • Provide support to your app's users, including account deletion if your app lets users create accounts.
  • Make sure your app, advertising, third-party SDKs, and any purchases are lawful and properly disclosed.
  • Keep repository access, build instructions, and demo credentials current for as long as we need them.

Do not send us end-user data unless it is needed for review or support and you have the right to share it. We may rely on the information you give us. Tell us promptly if something changes.

Prohibited apps and store rules

Our Prohibited Apps policy is part of these terms. We may decline or remove an app that falls within a prohibited category, breaks these terms, breaks a store policy, or creates a legal or account risk. You must also follow the App Store and Google Play rules for content, privacy, payments, account deletion, and store conduct.

Submissions, review, and discretion

Submitting an app does not oblige us to publish it. We review every app before publishing and may ask for changes. We may decline an app if it creates a risk to our developer accounts, breaks a policy or law, or falls outside what we can support.

We may also remove an app after it has been published if a problem appears later. We aim to explain material decisions, but we do not have to accept every submission.

Source code, credentials, and licence

You keep ownership of your app's code, name, branding, and content. To provide the service, you grant us a limited, non-exclusive, royalty-free licence to host, copy, build, sign, review, submit, display store assets for, and transfer your app. This licence lasts for as long as we need it to provide the service and wind down our work, including backups and legal records.

Our staff and service providers may access your source code, build files, credentials, and assets only as needed to review, build, publish, support, or transfer your app.

Send only credentials and environment variables that are needed for the build and store review. Use dedicated review credentials where possible, and do not include secrets that are not required.

Plans, credits, and fees

The current plan is RM199 per app per 12 months and includes 5 release credits valid from activation. Credits are sold in packages, not individually: when they are used, another RM199 package provides 5 more. The Pricing page shows the current price and allocation. We may change future pricing.

One credit covers one release cycle, whether it targets iOS, Android, or both. A credit is charged when we begin work on a submitted release. It remains allocated to that release through store rejections and resubmissions of the same release. A later release needs a new credit. Build failures caused by your code do not use a credit, but you must fix them.

Payment must clear before we begin work. Prices are shown in Malaysian ringgit. Except where required by law, fees are non-refundable once a release has been submitted for review. If you believe a charge is wrong, contact us.

If a payment fails or remains unpaid, we may pause the related work or cancel the subscription.

Renewal, expiry, and unpublishing

Subscriptions do not renew automatically. A renewal is a new purchase. If you do not renew before the term ends, your app remains published for 30 days after expiry, then we may unpublish it from the App Store and Google Play.

Unused credits expire at the end of the term and do not carry over. A renewal starts a new term with a fresh credit allocation. We may unpublish an app sooner if required by law, a store, or these terms.

App transfers

You may ask us to transfer your app to your own Apple Developer or Google Play developer account. We do not charge for the transfer, but Apple and Google control their transfer processes and requirements. You may need an active developer account of your own.

After a transfer is complete, the Publishing Agreement stops applying to that app, except for rights and records that survive. Apple's and Google's terms then govern your relationship with them.

Store review and timelines

Apple and Google review apps independently. We cannot guarantee approval, review time, or store placement. A rejection does not by itself mean you need a new credit for the same release, but you must fix the issue before we resubmit.

The plan price does not include fees that Apple or Google charge you directly, including any fees that apply after you transfer an app to your own accounts.

Availability and changes

We aim to keep Shiptavio available, but we may change, suspend, or discontinue parts of the service. We may also perform maintenance that interrupts access.

We are not a backup service. Keep your own copies of source code, store assets, listing text, and other material you need.

Third-party services

Shiptavio relies on services from Apple, Google, GitHub, payment providers, hosting providers, and email providers. Their terms and privacy policies apply to their services. We are not responsible for a third party's service, decisions, or downtime.

Intellectual property

The Shiptavio name, logo, website, dashboard, software, and documentation are owned by us or our licensors. We grant you a limited, non-transferable right to use the dashboard for the service, subject to these terms.

You may not copy, modify, resell, or reverse engineer the platform except as allowed by law. You keep all rights to your app and the content you submit.

Privacy

Our Privacy Policy explains how we handle personal data on Shiptavio.

You are responsible for personal data in your app and for meeting the privacy laws that apply to it. Do not send us end-user data unless it is needed for review or support and you have the right to share it.

Suspension and termination

We may suspend or end your access, or remove an app, if you break these terms, fail to pay, break a store policy or law, commit fraud, or create a risk to our developer accounts or the service.

You may stop using Shiptavio at any time. On termination, access ends and live apps may be unpublished after any required process. Fees remain non-refundable except where law requires otherwise.

The sections that by their nature should survive termination, including intellectual property, disclaimers, limitation of liability, indemnity, and governing law, continue to apply.

Disclaimers

To the fullest extent permitted by law, Shiptavio is provided "as is" and "as available". We disclaim implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. We do not promise that the service will be uninterrupted or error-free, that a store will approve your app, or that the service will meet every requirement you have. Nothing in these terms limits rights that cannot be limited by law.

Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, exemplary, or punitive losses, or for lost profits, revenue, data, goodwill, or business interruption.

Our total liability for all claims relating to the service in the 12 months before the event giving rise to the claim will not exceed the amount you paid us for the affected app in that period. This limit does not apply to liability that cannot be limited by law.

Indemnity

You agree to defend, indemnify, and hold harmless us and our personnel from claims, losses, liabilities, and costs, including reasonable legal fees, arising from your app, your content, your end-user data, your breach of these terms or a store policy, or your breach of law.

Governing law

These terms are governed by the laws of Malaysia, without regard to conflict-of-law rules. The courts of Malaysia have exclusive jurisdiction, except where mandatory consumer law gives you another forum. Before starting a formal claim, contact us and give us a reasonable chance to resolve the issue.

Changes to these terms

We may update these terms from time to time. We will post the new version and update the date at the top. If a change is material, we will provide notice by email or in the dashboard where appropriate. If you do not agree to a change, stop using Shiptavio before it takes effect. Continued use after the effective date means you accept the updated terms where the law allows.
